Three suspects accused of killing a visiting New Zealand tourist during a shopping mall robbery are facing further delays in court.

Leroy McCrary (26), Malachi Darnell (18), and Jaden Cunningham (18) were scheduled for arraignment but refused to leave their jail cells.

The 68-year-old victim, Patricia McKay, was allegedly struck by a getaway car driven by McCrary after a robbery attempt outside a Barnes & Noble at the upscale Fashion Island mall in Newport Beach on July 2nd.

All three face charges of murder, robbery, and conspiracy.

The judge expressed confusion over their absence and requested a hearing on Wednesday. Prosecutors claim McCrary, with a history of similar robberies, was on probation at the time due to California’s justice policies.
